Terms of Service

1. Acceptance

These Terms govern your use of the LearnManager app, website, and related services. By using LearnManager, you agree to these Terms and to our Privacy Policy. If you use LearnManager for a child, you agree that you are the parent, guardian, or authorized adult responsible for that child's use.

2. What LearnManager Provides

LearnManager is a parent-led education tool for setting up child learning profiles, choosing reading and early math goals, assigning activities, generating custom activities, and reviewing progress. Activities are supplemental learning materials and are not a school, tutoring service, professional educational assessment, medical service, or therapy service.

3. Accounts and Eligibility

Adults may begin with an anonymous Supabase session. Account claiming with Sign in with Apple may be required before paid checkout, public publishing, recovery-sensitive actions, or cross-device restore. Children may not create accounts or manage billing.

You are responsible for keeping access to your device and claimed account secure. If you lose access to an anonymous unclaimed session, we may not be able to restore that account.

4. Parent and Guardian Responsibilities

  • You are the parent, guardian, or authorized adult responsible for each child profile you create.
  • You will provide only accurate, appropriate, and minimized child learning information.
  • You will review AI-generated activities for suitability before relying on them with a child.
  • You will supervise child use of activities and learner mode.
  • You will delete child profiles or account data when you no longer have authority to manage them.

5. AI-Generated Activities

LearnManager uses AI to produce learning activities and supporting content. AI output can be incomplete, inaccurate, too easy, too hard, or otherwise unsuitable. You are responsible for reviewing activities and deciding whether they are appropriate for your child.

We may moderate, reject, remove, or block content that violates these Terms, appears unsafe for children, infringes rights, or creates risk for the service.

6. Your Content and Generated Content

You keep ownership of prompts, uploads, feedback, and other content you provide. You grant LearnManager the rights needed to host, process, transform, display, secure, and improve the service using that content. Generated activities are provided for your personal, household, or authorized educational use and may not be resold or commercially distributed.

LearnManager owns the app, website, software, designs, trademarks, and service infrastructure. These Terms do not transfer our intellectual property rights to you.

7. Acceptable Use

You agree not to:

  • Use the service for unlawful, deceptive, harmful, or abusive purposes.
  • Create, request, upload, or share content that is unsafe or inappropriate for children.
  • Attempt to bypass account, billing, quota, publication, or learner-mode restrictions.
  • Reverse engineer, scrape, overload, or interfere with the service or its infrastructure.
  • Upload malware, infringing content, or content you do not have the right to use.
  • Use generated activities as a substitute for professional educational, medical, therapeutic, or safety advice.

8. Payments and Subscriptions

Paid plans are processed through Stripe Checkout in an external browser. In the v1 iOS TestFlight app, LearnManager does not enable native in-app purchases, and cancellation is handled through the direct LearnManager billing flow.

Subscriptions renew automatically unless cancelled before renewal. You can manage direct subscriptions through the LearnManager billing flow or by contacting support@learnmanager.ai. Account deletion immediately cancels active Stripe subscriptions, but past payment and tax records may be retained as required by law.

Paid-upgrade availability may be limited by region. Prices, plan limits, trial offers, and features may change with notice where required.

9. Public Sharing

User-generated activities are private by default. If you publish an activity, you are responsible for ensuring you have the right to share its content and that it does not include private child, family, school, or third-party information.

10. Privacy and Child Data

Our data practices are described in the Privacy Policy. You agree to provide child data only when you have authority to do so and to request deletion when that authority ends.

11. Availability and Changes

We may change, suspend, limit, or discontinue parts of the service. We may also update these Terms. If a change is material, we will provide notice through the app, email when available, or this page where required.

12. Termination

You may stop using LearnManager or delete your account at any time. We may suspend or terminate access if you violate these Terms, create safety or security risk, fail to pay required fees, or if continued access would expose us or others to legal or operational risk.

13. Disclaimers

The service is provided "as is" and "as available." To the fullest extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and uninterrupted service. We do not guarantee educational outcomes.

14. Limitation of Liability

To the fullest extent allowed by law, LearnManager will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, service interruption, third-party conduct, or educational outcomes. Our total liability for claims relating to the service will not exceed the greater of the amount you paid LearnManager in the 12 months before the claim or 100 USD.

15. Indemnity

You agree to defend and indemnify LearnManager from claims, damages, liabilities, and expenses arising from your use of the service, your content, your violation of these Terms, or your violation of another person's rights.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Hawaii, United States, excluding conflict-of-law rules, unless mandatory consumer protection law requires otherwise. Before filing a formal claim, you agree to contact support@learnmanager.ai and give us 30 days to try to resolve the dispute informally.
