1. Acceptance of Terms

Welcome to LearnManager. These Terms of Service ("Terms") govern your use of the LearnManager mobile application and related services (collectively, the "Service") operated by LearnManager ("we", "our", "us").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

If you are using the Service on behalf of a child, you represent that you are the parent or legal guardian and accept these Terms on behalf of yourself and the child.

2. Eligibility and Account Registration

Age Requirements

  • You must be at least 14 years old to create an account
  • Users between 14-18 must have parental or guardian consent
  • Children under 14 may use the Service only through a parent or guardian's account

Account Responsibilities

When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information as needed
  • Keep your password secure and confidential
  • Not share your account credentials with others
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Description of Service

LearnManager is an educational platform that uses artificial intelligence to generate personalized learning activities for children. The Service includes:

  • AI-generated educational activities
  • Learning progress tracking
  • Child profile management
  • Push notifications for new activities
  • Subscription-based premium features

Service Availability

We strive to maintain Service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

  • Scheduled maintenance
  • Technical issues
  • Updates and improvements
  • Factors beyond our control

4. Use of Service

Permitted Use

You may use the Service for:

  • Personal, non-commercial educational purposes
  • Creating and managing child learning profiles
  • Generating and using educational activities
  • Tracking learning progress

Prohibited Use

You agree NOT to:

  • Use the Service for any unlawful purpose
  • Violate any applicable laws or regulations
  • Impersonate any person or entity
  • Interfere with or disrupt the Service
  • Attempt to gain unauthorized access to any part of the Service
  • Reverse engineer, decompile, or disassemble the Service
  • Copy, modify, or distribute the Service or its content
  • Use automated systems (bots, scrapers) to access the Service
  • Transmit viruses, malware, or other harmful code
  • Harass, abuse, or harm other users
  • Use the Service to generate inappropriate content for children
  • Circumvent any access restrictions or usage limits
  • Resell or commercially exploit the Service

5. Child Profiles and Parental Responsibility

Parental Consent

By creating a child profile, you represent and warrant that:

  • You are the parent or legal guardian of the child
  • You consent to the collection and use of the child's information
  • You will supervise the child's use of generated activities
  • You accept responsibility for ensuring activities are appropriate

Content Review

While we strive to generate age-appropriate educational content:

  • AI-generated content may occasionally be imperfect
  • We recommend reviewing activities before use with children
  • You can report inappropriate content through the app

Child Data Control

Parents maintain full control over child profiles and can:

  • View all collected information
  • Edit or update child information
  • Delete child profiles at any time
  • Export child data upon request

6. AI-Generated Content

Nature of AI Content

Educational activities are generated using artificial intelligence. You acknowledge that:

  • AI content is generated algorithmically based on input parameters
  • Content quality may vary
  • We do not guarantee educational outcomes
  • Activities are suggestions, not professional educational advice

Content Accuracy

While we strive for accuracy:

  • AI may occasionally produce errors or inaccuracies
  • Content should be reviewed by adults before use
  • We are not responsible for learning outcomes
  • Consult educational professionals for specific learning needs

Reporting Issues

If you encounter inappropriate or inaccurate content:

  • Use the in-app reporting feature
  • Contact support@learnmanager.ai
  • We will review and address issues promptly

7. Intellectual Property

Our Intellectual Property

The Service and its original content, features, and functionality are owned by LearnManager and are protected by:

  • Copyright laws
  • Trademark laws
  • Other intellectual property rights

This includes but is not limited to:

  • The LearnManager name and logo
  • App design and user interface
  • Underlying software and algorithms
  • Documentation and marketing materials

License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and use the app on your personal devices
  • Access and use features according to your subscription
  • Use generated activities for personal educational purposes

AI-Generated Activities

Activities generated by the Service:

  • Are licensed to you for personal, non-commercial use
  • May not be resold or commercially distributed
  • May be shared within your household or classroom (for educators)

User Content

If you provide feedback, suggestions, or other content:

  • You retain ownership of your original ideas
  • You grant us a license to use feedback to improve the Service
  • We may implement suggestions without compensation

8. Subscriptions and Payments

Subscription Plans

We offer various subscription plans with different features and pricing. Details are available in the app and on our website.

Payment Terms

  • Payments are processed through third-party providers (Apple App Store, Google Play, Stripe)
  • Subscriptions automatically renew unless cancelled
  • You are responsible for all applicable taxes

Free Trials

If offered:

  • Free trials provide temporary access to premium features
  • You will be charged after the trial unless you cancel
  • One free trial per user/household

Cancellation

You may cancel your subscription at any time:

  • Through your app store account settings
  • Cancellation takes effect at the end of the current billing period
  • You retain access until the period ends

Refunds

Refund policies are governed by:

  • Apple App Store terms for iOS purchases
  • Google Play terms for Android purchases
  • Our refund policy for direct purchases (contact support@learnmanager.ai)

We may offer refunds at our discretion for:

  • Technical issues preventing service use
  • Billing errors
  • Other circumstances we deem appropriate

Price Changes

We may change subscription prices:

  • With advance notice (at least 30 days)
  • Changes apply to the next billing cycle
  • You may cancel if you do not accept new pricing

9. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the Service, you consent to our data practices as described in the Privacy Policy.

10. Disclaimers

"As Is" Provision

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF CONTENT

Educational Disclaimer

  • We are not a school, tutoring service, or educational institution
  • Activities are supplemental and should not replace formal education
  • We do not guarantee academic improvement or learning outcomes
  • Consult qualified educators for specific learning needs

AI Limitations

  • AI-generated content may contain errors
  • We do not guarantee content accuracy or appropriateness
  • Human review of activities is recommended
  • AI capabilities may change over time

11. Limitation of Liability

Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED:

  • The amount you paid us in the 12 months preceding the claim, OR
  • $100 USD, whichever is greater

Excluded Damages

WE SHALL NOT BE LIABLE FOR ANY:

  • Indirect, incidental, special, or consequential damages
  • Lost profits, data, or goodwill
  • Service interruption or data loss
  • Third-party conduct or content
  • Unauthorized access to your data
  • Educational outcomes or learning results

Exceptions

Some jurisdictions do not allow limitation of liability for certain damages. In such cases, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless LearnManager and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you submit or share
  • Your child's use of the Service under your account

13. Termination

Termination by You

You may terminate your account at any time through the app settings or by contacting support@learnmanager.ai.

Termination by Us

We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activity
  • Abuse or harm the Service or other users
  • Fail to pay subscription fees

We may also terminate accounts:

  • With 30 days notice for any reason
  • Immediately if required by law

Effect of Termination

Upon termination:

  • Your right to use the Service ends immediately
  • Your account and data will be deleted (subject to legal retention requirements)
  • You remain liable for any outstanding payments
  • Provisions that should survive (e.g., limitation of liability) will continue

14. Dispute Resolution

Informal Resolution

Before filing a formal dispute, you agree to contact us at support@learnmanager.ai to attempt informal resolution. We will try to resolve disputes within 30 days.

Governing Law

These Terms are governed by the laws of the applicable jurisdiction, without regard to conflict of law principles.

Jurisdiction

Any disputes not resolved informally shall be resolved in the appropriate courts, and you consent to personal jurisdiction in such courts.

Class Action Waiver

To the extent permitted by law, you agree to resolve disputes on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration.

15. Changes to Terms

We may modify these Terms at any time. When we make changes:

  • We will update the "Last updated" date
  • We will notify you of material changes via email or in-app notice
  • Changes take effect 30 days after notice for existing users
  • Continued use after changes constitutes acceptance

If you do not agree to updated Terms, you must stop using the Service and may request account deletion.

16. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and LearnManager regarding the Service.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

Waiver

Our failure to enforce any provision does not waive our right to enforce it later.

Assignment

You may not assign your rights under these Terms. We may assign our rights to a successor in interest.

Notices

We may send notices to your registered email address. You may contact us at support@learnmanager.ai.

No Partnership

These Terms do not create any partnership, joint venture, or agency relationship between you and LearnManager.

Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control (natural disasters, war, pandemic, etc.).
